Mr. Shields needs permission from the Court of Appeals to proceed. 28 U.S.C. 2244(b)(3)(A). Therefore, his motion to transfer should be GRANTED. His #1 petition for writ of habeas corpus and #10 amended petition for writ of habeas corpus should be transferred to the United States Court of Appeals for the Eighth Circuit for consideration as a request for authorization to proceed with a second or successive habeas petition. Mr. Shields's motion to hold his case in abeyance while the court of appeals considers his request to file a successive petition, however, should be DENIED because this Court currently lacks jurisdiction to stay the case.
