ORDER Dismissing First Amended Complaint for Failing to State a Claim and as Frivolous Pursuant to 28 U.S.C. 1915(e)(2)(B) & 1915A(b): It is hereby ordered that Plaintiff's First Amended Complaint is dismissed without prejudice for failing to st ate a claim upon which relief may be granted and as frivolous.
