ORDER INDICATIVE RULING PURSUANT TO FED. R. CIV. P. 62.1 RE NOTICE OF APPEAL. On October 26, 2018, plaintiff filed a pro se complaint and motion to proceed in forma pauperis. Docs. #1 and #2 . On November 5, 2018, the Court entered an order requiring plaintiff to file a 6-month ledger sheet by November 26, 2018, and advising that the case would be dismissed if not filed by that date. Doc. # 6 . On November 30, 2018, the Court dismissed the case for failure of plaintiff to file the ledger sheet. Doc. # 7 . On December 7, 2018, plaintiff untimely filed a 6-month ledger sheet dated November 29, 2018. Doc. #8 . On December 14, 2018, plaintiff filed a notice of appeal from the Court's dismissal of this case. Doc. #9 . Because of plaintiff's filing of a notice of appeal (rather than a motion for reconsideration), this Court no longer has jurisdiction over this action. See United States v. Rodgers, 101 F.3d 247, 251 (2d Cir. 1996). Pursuant to Fed. R. Civ. P. 62.1, however, the Court states that in light of plaintiff's filing of the required 6-month ledger sheet and in light of the ledger sheet's indication that plaintiff would qualify for in forma pauperis status, the Court would intend to grant plaintiff's motion to proceed in forma pauperis in the event that the Court of Appeals enters an order of remand.
