WRITTEN Opinion entered by the Honorable Blanche M. Manning on 8/30/2011: Plaintiff's motion for leave to amend his complaint [# 34 ] is granted. On initial review pursuant to 28 U.S.C. section 1915(A) the Court finds that Plaintiff's thi rd amended complaint [# 35 ] (erroneously labeled as Second Amended Complaint) may proceed. Summons shall issue as to Defendants Correctional Officer Wright and David Fagus and the U.S. Marshal service is directed to effect service. In addition, the Clerk shall send Plaintiff a magistrate judge consent form and filing instructions along with a copy of this order. The Court will not accept any further amended complaints in this case without good cause and as justice requires.
