Filing 5 OPINION AND ORDER: The court GRANTS Jason Jones leave to proceed on an Eighth Amendment claim for money damages against Ms. Frazier for allegedly failing to protect him from the hazardous condition of pushing a food cart with faulty wheels in September 2019; DIRECTS the clerk to add the Warden of the Westville Correctional Facility as a defendant; GRANTS Jason Jones leave to proceed on an Eighth Amendment claim for money damages against Wexford of Indiana for allegedly maintaining a policy or practice of failing to properly train medical staff to properly diagnose and treat prisoners that acted as the moving forced for the inadequate treatment for his left knee injury; GRANTS Jason Jones leave to proceed on an injunctive relief claim against Warden of the Westville Correctional Facility in his official capacity to obtain the medical treatment for his left knee injury to which he is entitled under the Eighth Amendment; DISMISSES Aramark; DISMISSES all other claims; DIRECTS the clerk and the United States Marshals Service to issue and serve process on the Ms. Frazier, Wexford of Indiana, and the Warden of the Westville Correctional Facility at the Indiana Department of Correction with a copy of this order and the complaint #1 as required by 28 U.S.C. 1915(d); ORDERS, pursuant to 42 U.S.C. 1997e(g)(2), Ms. Frazier, Wexford of Indiana, and the Warden of the Westville Correctional Facility to respond, as provided for in the Federal Rules of Civil Procedure and N.D.
