Filing 153 Order Granting Motion for Summary Judgment, Granting Motion to Strike and Directing Entry of Final Judgment - Mr. Jones' claim regarding black mold is dismissed without prejudice. Because Mr. Jones has not identified a genuine issue of materia l fact as to his H. pylori claim in this case, the defendant is entitled to judgment as a matter of law on that claim. Therefore, the defendant's motion for summary judgment, dkt. 125 , is granted. Additionally, the defendant's motion to strike, dkt. 141 , is granted.
