ORDER ON PLAINTIFF'S PENDING MOTIONS - Mr. Thompson's motion, dkt. #10 , is GRANTED to the limited extent that if he is seeking to proceed in this action without prepayment of the filing fee, he may file a motion for leave to proceed in forma pauperis that must include a copy of the transactions associated with his institution trust account for the six-month period preceding the filing of this action. Mr. Thompson's motion for leave to proceed in forma pauperis, dkt. #12 , is DENIED as presented. Mr. Thompson should continue to work with the facility to attain his trust account statement. The Court will permit Mr. Thompson extended time, through August 17, 2023, to renew his motion for leave to proceed in forma pauperis supported by his institution trust account statement. this Court cannot initiate a proceeding on Mr. Thompson's behalf in state court or transfer it to state court, and therefore, his motion, dkt. #11 , is DENIED. ORDER DENYING WITHOUT PREJUDICE PLAINTIFF'S RENEWED MOTIONS TO APPOINT COUNSEL: Mr. Thompson's renewed motions to appoint counsel, dkts. #7 and #8 , are DENIED without prejudice. At this time, Mr. Thompson should continue efforts to recruit counsel on his own. He continues to have through July 17, 2023, to pay the $402.00 filing fee for this action or to file a motion for leave to proceed in forma pauperis. See dkt. 6 (Failure to correct this deficiency "may subject the case to dismissal for failure to prosecute."). The Court will remain alert to changes in circumstances that may warrant reconsideration of Mr. Thompson's requests for counsel, such as a settlement conference or trial. See Order.
