Defendant April Smith's Motion to Dismiss and Decline Jurisdiction under the Federal Declaratory Judgment Act [R. 6 ] is GRANTED; 2. The Court, in its discretion, declines to exercise jurisdiction over this matter pursuant to the Federal Declaratory Judgment Act, 28 U.S.C. § 2201, and this action is DISMISSED without prejudice. 3. April Smith's Motion to Dismiss for Lack of Subject Matter Jurisdiction, Motion for a More Definite Statement, and Motion to Dismiss for Failure to State a Claim [R. 6 ] are therefore DENIED as moot.
