MEMORANDUM AND ORDER: "In accordance with the foregoing, 1) the Court finds that plaintiff has alleged sufficient facts to demonstrate that the defendant officers acted under color of law, but 2) becaus e the plaintiff's injury was not caused by a municipal policy, custom or failure to train defendant officers, the Town of Brookline's motion for judgment on the pleadings (Docket No. 36 ) is ALLOWED, and 3) Count III of the Amended Complaint is DISMISSED.
