The Court DISMISSES all of Newman's claims against the LBHI Defendants except for the section 502(a)(1 )(B) claim that may be asserted against the Plan, which includes the STD Plan, the LTD Plan, the Supplemental Plan and the Life Insurance Plan. Newman's motion for leave to amend is GRANTED in part and DENIED in part. Newman is GRANTED leave to amend the complaint to include a SOX claim within fourteen days of this Order. (Hourihan, Lisa)
