August 30, 2017 Filing 145 Chief Judge Patti B. Saris: ORDER entered. The motion to lift the stay for the 459, 442 and 745 patents is DENIED for the following reasons. The claims in the patents involve computer technology that is highly complex and demands a significant amount of judicial time to understand. All the patents and a substantial number of claims have Inter Partes Review (IPR) instituted. While not all claims are under review, Defendants have persuaded the court that there is a significant overlap between the issues before the Patent Trial and Appeals Board and the claims in litigation. The stay creates no undue hardship for Intellectual Ventures (IV), a non-practicing entity. As IV points out, it can argue for pre-judgment interest to compensate it for unfair delay. Moreover, this case is in its infancy with no discovery and no trial in sight. No Markman hearing has been held. Staying the case pending IPR makes common sense and will save cents. The IPR review will resolve, streamline and clarify the issues and save the Court and parties from unnecessary expenditures of time and money. IV may move to lift the stay once the IPR for a patent is fully resolved before the Board. The Court will not stay the case for an IPR filed by a non-party unless all defendants agree to be bound by the Board ruling. The Court will not wait until all IPRs are fully resolved before the Board for all patents. The Court will also not stay the case pending an appeal to the Federal Circuit.
