The Court determines that: (1) Ethicon has failed to meet its burden to establish that any of the asserted claims of either United States Patent No. 9,241,759 or United States Patent No. 8,323,310 is invalid, and (2) Covidien has failed to meet its burden to establish that the Enseal X1 infringes any of the asserted claims of either of these two patents. Within fourteen days, the parties shall file a proposed form of judgment encompassing all claims in this litigation (Montes, Mariliz)
