The facts concerning this case were set out at length in the court's prior Report and Recommendation concerning plaintiff's Motion to Remand to State Court. (#45.) Here, Lamorak seeks documents and interrogatory responses from plaintiff LMR relating to LMR's billing and allocation of other matters, namely, its 2009 settlement with Olin. (#63 at 1.) The 2009 settlement resolved environmental liabilities arising from hundreds of insurance policies that the London Market Insurers had issued to Olin over several decades. The positions taken by those insurers depended on the particular policy language of each contract and the various facts of those cases. Even if, as Lamorak contends, one could argue that LMR took inconsistent positions between those matters and this case, the court here still must interpret the contract in this case and decide this case on its own facts. Thus, the relevance of the materials sought is too speculative. LMR further makes a compelling argument, supported by affidavits, that producing the discovery would be difficult and unduly burdensome. (#74 at 23-24.)A similar request by Lamorak seeking discovery from Lloyd's Underwriters previously was denied by a Massachusetts Superior Court judge in a companion case. (#65-18.) Thus, the court here agrees with LMR that the discovery requests seek information that is not relevant, and even if it were relevant, would be unduly burdensome for LMR to produce under Fed. R. Civ.
