After hearing argument, the court orders defendants to inform plaintiff no later than Wednesday, January 16, 2019, (based on review of material which defendants have already done), which of the 142 films provided to plaintiff contain scenes relevant to this case, any details defendants know about where on the videos those images appear, and which films do not contain relevant information. No later than January 23, 2019, defendants shall provide plaintiff with an affidavit by whomever searched for the films stating what efforts were made to locate them, why any were missed, and what efforts have been made to locate any further films, and attesting that to the best of their knowledge there are no other films containing relevant information in the possession of defendants. Counsel for Mile High Media, Attorney Kaufman, stated that plaintiff incorrectly has directed discovery requests to Jon Blitt, rather than Mile High Distribution, Inc.. The court notes that on the docket, Defendant Jon Blitt is named as "personally doing business as Mile High Medica [sic] doing business as ICON Male doing business as Transsensual." The court allows plaintiff to re-send discovery requests to Mile High Distribution, including ten interrogatories concerning the 22,000 still photographs which defendants sent plaintiff.Plaintiff has asked for the names and contact information of the approximately 33 actors who appeared in the films in question. Plaintiff shall file a motion setting out the reasons for this request and defendant shall respond.Plaintiff is also going to ask Mile High Distribution, Inc. for the names of all the distributors who received materials that were filmed or photographed at plaintiff's home. Defendant Mile High Distribution may file an objection to this request, but the court indicated that would be inclined to order the production of this information. The court explains to counsel the court's protocol for dealing with discovery disputes in the future.
