PUMA represents that it intends to seek IPR of two additional patents-in-suit once it is able to do so, later this month and in mid-July of this year. Nike opposes PUMA's motion on several grounds. For example, NIKE notes that PUMA did not petition the PTAB for Post Grant Review of any of the patents, though it could have done so, and emphasizes that, to date, the PTAB has not actually instituted IPR proceedings as to any of the patents-in-suit. Accordingly, on the present record, PUMA's Motion to Stay Pending Inter Partes Review (Doc. No. 84) is DENIED. (Montes, Mariliz)
