Date Filed Document Text
May 23, 2019 Filing 35 STIPULATION of Dismissal by Bank of New York Mellon Corporation, Carrington Mortgage Services, LLC. (Stephens, Christian)
May 15, 2019 Filing 34 First Opposition re #28 MOTION for Settlement and/or to Enforce Settlement filed by Vinieta Lawrence. (Sullivan, Gregory)
May 10, 2019 Filing 33 Judge Allison D. Burroughs: ELECTRONIC ORDER entered ECF No. #31 , Motion to Withdraw and Extend Time to June 7 to Oppose Motion to Enforce Settlement, is DENIED, and ECF No. #32 , Motion for Extension of Time to File Response/Reply, is hereby resolved. Plaintiff shall file her opposition to the motion to enforce settlement by 12:00 PM on May 22, 2019. Although the Court sympathizes with Counsel Sullivan's circumstance, the Court denies his request to withdraw at this time given his participation in the purported settlement agreement and the Court's wish to maintain the parties' ECF filing capabilities, where it is unclear whether Ms. Lawrence has an ECF account and she has filed an appearance through current counsel that does not have a bar number. Considering that the Court cannot predict the exact assertions that Plaintiffs' as yet unfiled opposition will contain, the parties shall confer and shall provide a list of potential times for an 30 minute evidentiary hearing for the week of May 27, 2019 to the Court's courtroom deputy by May 17, 2019. Counsel Sullivan shall attend any such hearing. (McDonagh, Christina)

May 3, 2019 Filing 30 Judge Allison D. Burroughs: ELECTRONIC ORDER entered. On April 15, 2019, Defendants Carrington Mortgage Services, LLC and Bank of New York Mellon Corporation moved to enforce a settlement agreement that the parties purportedly reached on March 22, 2019. [ECF No. #28 ]. In accordance with Local Rule 7.1(b)(2), any opposition to the motion to enforce settlement was due on April 29, 2019, and no opposition has been filed. If Plaintiff intends to oppose the motion, she shall file her opposition by May 7, 2019 and her counsel shall show cause for the delay at that time. If Plaintiff fails to oppose the motion or to establish good cause for the delay, the Court will grant the motion as unopposed. The supporting documentation filed by Defendants, see [ECF No. #29 -1], strongly suggests that a settlement of this matter was agreed to. Particularly given that Plaintiff appears to have developed a health problem that may impact her ability to relocate on short notice, and that the May 31, 2019 vacate date is approaching, the Court suggests that Plaintiff and her counsel act expeditiously on the motion and further, that they begin to consider alternative living arrangements regardless of whether or not they intend to oppose the motion.(McDonagh, Christina)
