Filing 5 Judge Mark G. Mastroianni: ELECTRONIC ORDER entered. Pursuant to Fed. R. Bankr. P. 9033(b), objections to the bankruptcy courts proposed findings of fact and conclusions of law are to be filed [w]ithin 14 days after being served with a copy of the proposed findings or conclusions objected to and state the grounds for such objection. Additionally, [a] party objecting to the bankruptcy judges proposed findings or conclusions shall arrange promptly for the transcription of the record. Id. Requests for extensions of time to file objections are to be filed with the bankruptcy judge. Fed. R. Bankr. P. 9033(c); see also Hunt v. Parkway Trans., Inc., 254 B.R. 561, 564-65 (W.D. Tex. 2001) (comparing rules for district court review of magistrate judges report and recommendation and bankruptcy judges proposed findings and conclusions and concluding that pursuant to bankruptcy rules, only a bankruptcy judge can grant an extension of time for filing objections). As no objections appear to have been filed, this court takes the bankruptcy courts proposed findings of fact and conclusions of law under advisement. Following de novo review, the scope of which is necessarily limited by the absence of a record beyond the bankruptcy courts proposal, this court will issue its order. (Rivera, Christina) |
