April 26, 2019 Filing 3 Judge Richard G. Stearns: ORDER entered. SERVICE ORDER re 2241 Petition. 1. Joseph D. McDonald, Jr., Plymouth County Sheriff, shall be the sole respondent in this action. The Clerk shall terminate as parties Matthew Whitaker, Kirstjen Nielsen, and Todd Lyons. 2. The clerk shall serve a copy of the petition upon (i) Sheriff McDonald; and (ii) the United States Attorney for the District of Massachusetts. 3. The respondent shall, within 21 days of the date of this order, respond to the petition. If the respondent opposes the petition, he must file a memorandum setting forth the facts and legal arguments in support of his opposition. 4. Unless otherwise ordered by the court, during the pendency of this action the respondent shall not transfer Khaled outside of the District of Massachusetts unless it is to effectuate his removal. For purposes of this order, effectuating removal includes, but is not limited to, travel for interviews, procedures, meetings, or other events where Khaleds presence is necessary for the anticipated procurement of travel documents. The respondent shall promptly notify the court if Khaled is moved outside of the District of Massachusetts, the reason therefor, and, if applicable, the projected date of Khaleds return to the District of Massachusetts.(PSSA, 4)
