Saris: ELECTRONIC ORDER entered denying without prejudice #2 Motion for Leave to Proceed in forma pauperis "Petitioner's motion to proceed in forma pauperis (the "Motion,"ECF No. 2) is hereby DENIED without prejudice. A motion for leave to proceed without prepayment of the filing fee must be accompanied by a certificate from the warden or other appropriate officer of the place of confinement showing the amount of money or securities that the petitioner has in any account in the institution. Rule 3(a)(2) of the Rules Governing Section 2254 Cases. Petitioner has failed to provide the certified prison account statement, claiming prison officials refuse to provide the certification. Motion, 1-2. Accordingly, if petitioner wishes to proceed with this action, he shall by August 30, 2019, either: (1) pay the $5.00 filing fee; or (2) file a motion for leave to proceed in forma pauperis accompanied by a certified prison account statement. Failure of petitioner to comply with this directive may result in the dismissal of this action without prejudice. For the convenience of litigants, this Court provides a form application to seek leave to proceed in forma pauperis. The Clerk shall also send a copy of this Order to the Treasurer's Office at the prison facility in which petitioner is incarcerated. The Court requests, but does not order, the prison facility to facilitate any request by the petitioner for his certified prison account statement." (PSSA, 5)
