January 19, 2021 Filing 85 Judge Indira Talwani: ELECTRONIC ORDER denying further relief on Plaintiff's Motion for Spoliation Sanctions #43 . Under Federal Rule of Civil Procedure 37(e), if electronically stored information that should have been preserved in the anticipation or conduct of litigation is lost because a party failed to take reasonable steps to preserve it, and it cannot be restored or replaced through additional discovery, the court "upon finding prejudice to another party from loss of the information, may order measures no greater than necessary to cure the prejudice" or "upon finding that the party acted with the intent to deprive another party of the information's use in the litigation may: (A) presume that the lost information was unfavorable to the party; (B) instruct the jury that it may or must presume the information was unfavorable to the party; or (C) dismiss the action or enter a default judgment." Fed. R. Civ. P. 37(e)(1), (2). In initially addressing Plaintiff's pretrial Motion for Spoliation Sanctions #43 , the court found "that electronically stored information [ESI] that should have been preserved in the anticipation and conduct of litigation was lost because Defendants failed to take reasonable steps to preserve it," that the lost ESI comprised backups of Defendants' Spryng.io website prior to an unspecified date in December 2019, and that "this information cannot be restored or replaced through additional discovery." Elec. Ord. 47 . The court held "in abeyance a determination as to (1) whether, and the extent to which, the loss of this electronically stored information prejudices Plaintiff and/or (2) whether the failure to preserve this information was intentional on the part of Defendants." Elec. Ord. 47 . The court finds no prejudice where Defendants did not challenge the authenticity of the Original and Revised webpage screenshots at trial and stipulated that "Jack Speranza was the principal author on Defendants' behalf" of the Original Version and Revised Version of the webpages, see Joint Pretrial Mem. 7-8 #71 , and where Plaintiff's fees incurred as a result of this spoliation have been awarded to Plaintiff pursuant to the Settlement Agreement as the prevailing party on the breach of contract claim. Accordingly, no further relief is available pursuant to Fed. R. Civ. P. 37(e)(1). The court also finds that, in light of the Stipulation that the webpages were posted and revised on "Defendants' behalf," the relief available under Fed. R. Civ. Proc. 37(e)(2) is unnecessary. Moreover, the court finds that neither Defendants' pretrial affidavits nor the evidence presented at trial presented a sufficient basis for the court to find that the failure to preserve this information was intentional on the part of Defendants. Accordingly, the court grants no further relief on the Motion for Spoliation Sanctions #43 . (Kelly, Danielle)

The motion was filed without the certificate required under Local Rule 7.1(a)(2) which requires that "[n]o motion shall be filed unless counsel certify that they have conferred and have attempted in good faith to resolve or narrow the issue." April 16, 2020 Filing 57 Judge Indira Talwani: ELECTRONIC ORDER: Pursuant to the court's Scheduling Order #38 , Plaintiff's expert disclosures and designations were to be completed by March 3, 2020, Defendants' expert designations and disclosures were to be completed by March 17, 2020, Plaintiff's rebuttal disclosures concluded by April 3, and expert depositions were to be concluded by April 17, 2020. Pursuant to the Order Granting the Parties' Stipulation to Extend Fact Discovery #51 , the remaining two fact depositions were to be concluded by April 2, 2020. On March 20, 2020, the court ordered counsel to file a Joint Statement no later than March 27, 2020, confirming that expert designations and disclosures had been completed as required by the Scheduling Order #38 , proposing a schedule to complete the two remaining fact witness depositions and any expert depositions, and stating whether they are proposing any change to the dispositive motion filing date. See Elec. Ord. 54 . Counsel disregarded the court filing deadline (filing nothing until April 15, 2020, and then failing to request to be excused for the late filing). The Joint Statement #56 acknowledges that the parties have failed to designate experts, and contends that that failure was caused by the pandemic. However, counsel offer no explanation for their failure to request that these deadlines be moved when they sought to extend fact discovery. See Stipulation #49 . Counsel also offer no proposal for completing these disclosures or fact and expert depositions, despite the courts order that they propose a schedule.The court understands that deadlines may be impacted by the current pandemic and once set, may need to be changed. The court finds no reason, however, to allow counsel to simply disregard the court's orders. Counsel are hereby ORDERED to file NO LATER THAN APRIL 23, 2020, a proposed schedule including: (1) deadlines for expert designations and disclosures; (2) deadlines for completion of the two remaining fact witness depositions and for expert depositions; and (3) a deadline for filing dispositive motions.
