May 18, 2020 Filing 180 Judge William G. Young: ELECTRONIC ORDER entered granting in part and denying in part #166 Motion to Compel. The motion to compel answers to interrogatories is ALLOWED as to interrogatories 6 and 9. The Court accepts plaintiffs counsels response that they have no such additional information as to interrogatory no. 6 after appropriate inquiry. Counsels objection to interrogatory no. 9 is overruled and a complete answer shall be furnished within 30 days of the date of this order. The motion is otherwise DENIED as immaterial. On or before Thursday, May 28, 2020 the defendants shall make a comprehensive and detailed report to the Court setting forth, with specific dates, the plan for testing staff and detainees at the Bristol facility as required by this Courts preliminary injunction. Comprehensive testing is key here. The Court is informed that the Massachusetts Department of Corrections has assured the Massachusetts Supreme Judicial Court that it is proceeding to test all DOC staff and is offering to test every inmate. Since, under our Constitution, ICE power to lock a person up is limited by its obligation to care for that person, surely ICE can be expected to care for its civil detainees at least as well as Massachusetts cares for its convicted felons. Since, under the orders presently. In place, no detainee is to leave the facility until such testing of staff and detainees has taken place, the defendants are under no additional duties to report beyond those presently ordered by this Court or other Judges thereof. The present conditions under which any of the detainees are being held is properly discoverable. The circumstances of Fridays disruption is not. Be it remembered that this is a habeas class action, not institutional reform litigation. The Court will propound at least the following two questions at Thursdays hearing: To plaintiffs counsel: Since it appears uncontroverted that certain detainees refused to be tested, isnt the Court entitled to assume they feared a positive test with the consequence of quarantine and collateral restrictions? To defense counsel: How many detainees remain in custody at the site (whether original class members or add ons) Exactly where are they and under what conditions are they being held? The numbers in each particular location within (or outside) the site. What opportunity, if any, do they have to intermingle and with whom? (Gaudet, Jennifer)

April 15, 2020 Filing 86 Judge William G. Young: ELECTRONIC ORDER entered denying #82 Motion to Stay Further Releases by Thomas M. Hodgson. "We are in the midst of a pandemic unprecedented in our lifetime. Past experience is an uncertain guide to meeting the challenges of today. Thus, while the Court notes the revised ICE regulations concerning detainees, it is simply not presently in a position to issue any blanket stay which would, as a practical matter, go far to determining the merits of this case, ignoring the many other issues raised by the class. Instead, the Court will continue, on an individual basis, to work through the difficult issues of bail in the present crisis. That done, probably by the end of next week, we shall together schedule proceedings promptly to address the merits. Moreover, compelling issues of individual, institutional, and community health preclude the luxury of a stay so counsel can 'consider their appellate options.' The motion is denied. The release of Sandro Vera Campoverde on bond means he drops out of the class. Augustine Ohenhen is denied bail. Neved Bai Maney Lal is to be released forthwith on the same bail terms as heretofore.
