July 1, 2020 Filing 7 Judge Denise J. Casper: ELECTRONIC ORDER entered denying without prejudice 5 Motion for Leave to Proceed in forma pauperis. "Plaintiff Kelechi Linardons (Linardon) renewed Application to Proceed in District Court without Prepaying Fees or Costs (D. 5) is DENIED without prejudice. It is FURTHER ORDERED that Linardon shall by July 22, 2020 either: (1) pay the $400 filing and administrative fee; or (2) file (by mail or as a courtesy by email to the Courtroom Deputy) a renewed and complete Application to Proceed in District Court without Prepaying Fees or Costs. The Court provisionally accepts Linardons electronic signature in the motion and representations made in her email to the Court. Nevertheless, Linardon has, again, failed to file a complete application. Linardon has previously been informed by this Court, and in another case, about the necessity to file complete applications to proceed in forma pauperis. Specifically, as recently as last year, she was twice denied in forma pauperis status for filing incomplete applications. See Linardon v. Castillo, 19-cv-11687, ECF Nos. 3,5,7, 8 and 9; see also Pisano v. Astrue, No. CIV.A. 11-30269-KPN, 2012 WL 79188, at *1 (D. Mass. Jan. 10, 2012) (observing that proceeding in forma pauperis in a civil case is a privilege or favor granted by the government) (citation and quotations omitted). If Linardon wishes to be considered for in forma pauperis status, she must file a complete application so that the Court may evaluate whether she is eligible to proceed in forma pauperis under 28 U.S.C. 1915. Specifically, this means that every question on the application must be answered, and not left blank. See Application, questions 3(a), 3(b), 3(c), 3(e) and 3(f), 4, 5, 6, 7 and 8. The Clerk is directed to provide Lindaron a copy of this order and Form AO 240 by email." (PSSA, 5)
July 1, 2020 Filing 6 Judge Denise J. Casper: ELECTRONIC ORDER entered. The Clerk's office has received a June 23, 2020 email from Plaintiff Kelechi Linardon (Linardon) that because of the Coronavirus Public Emergency, she has been unable to leave her home to access the post office and has been unable to print and sign documents. Pursuant to Local Rule 83.5.5(f), Linardon may elect to be served by email if she provides the clerk an email address at which service upon Linardon may be made. Accordingly, the Clerk is directed to provide a copy of this order to Linardon by email. If Linardon agrees to service by email, she shall notify the clerk, who will add Linardons email to her address on the docket. As a courtesy, in light of the ongoing coronavirus pandemic which imposes unique constraints on the regular functioning of the Court, see generally General Orders 20-2 through 20-25 in re Coronavirus Public Emergency, the Court will accept her email filing of her motion to proceed in forma pauperis (D. 5).
