Plaintiffs filed a Complaint on June 16, 2020, that comprises 137 pages, nearly 800 paragraphs, and 29 counts alleged against six defendants: Sheikh Khalid Bin Hamad Bin Khalifa Al Thani, Donald Greenbaum, Al Anabi Racing USA, LLC, Al Anabi Racing Limited, Speedtech LLC, and Al Anabi Performance, LLC. Defendants moved to dismiss or, in the alternative, for a more definite statement. Dkt. # 49, 51, 53. When plaintiffs opposed, Dkt. # 60, 61, 63, they attached to their briefs over 100 exhibits, see Dkt. #64-70, most of which were not cited anywhere in the papers. Defendants replied and separately moved to strike these exhibits. Dkt. # 75-78. Rule 12(e) provides that [a] party may move for a more definite statement of a pleading to which a responsive pleading is allowed but which is so vague or ambiguous that the party cannot reasonably prepare a response. Fed. R. Civ. P. 12(e). The court agrees with defendants that it is virtually impossible to decipher the Complaint and, therefore, to evaluate the sufficiency of the allegations against defendants. The Complaint is not coherently pled and contains a slew of extraneous allegations not germane to this matter. It is not the role of the court to cull through the allegations, identify the claims, and, as to each claim identified, select the allegations that appear to be germane to the claim. U.S. ex rel. Est. of Cunningham v. Millennium Labs. of California, Inc., 713 F.3d 662, 664 n.2 (1st Cir. 2013), quoting Ledford v. Peeples, 605 F.3d 871, 892 (11th Cir. 2010), vacated on other grounds, 657 F.3d 1263 (11th Cir. 2011). The court acknowledges that Sheikh Al Thani, Al Anabi Racing Limited, Speedtech LLC, and Al Anabi Performance, LLC, have raised personal jurisdiction objections. However, the court is unable to enter even a partial ruling on this ground because plaintiffs Complaint and oppositions fail to make clear which allegations and exhibits support their alter ego theory of personal jurisdiction. The court is reluctant to enter a dismissal with prejudice when it is impossible to determine whether the deficiencies reflect substandard pleading or a lack of jurisdiction. Separately, defendants duplicative filings fail to simplify matters. Any future briefing by the parties in this case shall be consolidated if plaintiffs or defendants are making the same or similar arguments. For the foregoing reasons, the court DENIES defendants motions to dismiss without prejudice and ALLOWS defendants motions for a more definite statement. Plaintiffs shall, by October 30, 2020, file an amended complaint that eliminates extraneous allegations, pleads facts in a simplified manner, and identifies which allegations are relevant to each count in language comprehensible to a person of reasonable intelligence or the case will be dismissed.
