An individual, Thomas Gorman, has submitted a letter to the Court, [ECF No. #6 ], purportedly on behalf of the named defendant, Gorman Associates LLC, and identifying himself as "pro se." However, the First Circuit has held that "[o]ne of the time-hallowed restrictions on corporations has been that, in court proceedings, they must be represented by a licensed attorney." In re Las Colinas Dev. Corp., 585 F.2d 7, 13 (1st Cir. 1978); see Indigo Am., Inc. v. Big Impressions, LLC, 597 F.3d 1, 2 (1st Cir. 2010) (discussing the "long-standing rule barring persons who are not licensed to practice law from representing corporations in judicial proceedings"). Local Rules in this District similarly preclude an officer from representing a corporation unless the officer is an attorney. Local Rule, D. Mass. 83.5.5(c) ("An individual officer, director, partner, member, trustee, administrator, or executor may not appear on behalf of an entity; provided, however, that if such an individual is also an attorney who is otherwise permitted to practice in this court, the attorney may represent the entity if the representation is otherwise appropriate under the circumstances."). This rule also provides that "[t]he court may strike any pleading filed on behalf of any entity that purports to appear pro se." Id. Gorman Associates may have legitimate arguments to raise regarding this lawsuit, but Mr. Gorman cannot raise those arguments absent entering an appearance as an attorney representing Gorman Associates, if he is an attorney, or seeking counsel to enter an appearance on behalf of Gorman Associates and respond to the complaint.
