Filing 12 Judge Denise J. Casper: ELECTRONIC ORDER entered re: #10 Motion to Remand. Having considered the motion, D. 10, and the opposition, D. 11, the Court ALLOWS the motion for remand. In removal to this Court, Defendants did so under federal question jurisdiction, 28 USC 1331. To determine whether a civil action is one "arising under the Constitution, laws or treaties of the United States," id., it is well settled that the Court must look at if the "plaintiff's claim to relief rests upon a federal right, and the court is to look only to plaintiff's complaint to find the answer." Rossello-Gonzalez v. Calderon-Serra, 398 F.3d 1, 10 (1st Cir. 2004) (emphasis in original and internal citation omitted). The allegation or existence of a "federal defense" is not sufficient for removal jurisdiction. Id. Given the nature of plaintiff's claims to relief here, having reviewed the first amended complaint, D. 1-2 at 8; D. 10-2, this Court does not have the federal question jurisdiction invoked here for removal and remand is warranted.
