Filing 8 Judge Indira Talwani: ELECTRONIC ORDER denying Petitioners Motion for Reconsideration #7 . Petitioner previously advised the court that he has completely served his sentence.... Petition 2 #1 . Petitioner now states that while he completed his imprisonment component of that sentence in June 2020, he has not completed his supervised release component of the sentence, see Mot. 2 #7 , presumably because he has been in immigration custody. While Petitioner is correct that unserved supervised release is sufficient to meet the in custody requirement for federal habeas relief, Petitioners Motion #7 does not address the balance of the courts Order #4 finding that the district court is without jurisdiction to entertain a challenge to Petitioners removal order or to the execution of that order. Id. at 2 #4 (citing 8 U.S.C. 1252(a)(5) & (g)). And as the court previously noted, Petitioners prior petitions for writ of error coram nobis and a habeas corpus under 28 U.S.C. 2255 have been denied. Id. at 1, n.1 (citations omitted). In sum, the court finds no grounds for reconsideration. (Kelly, Danielle) |
