The Petition was docketed and assigned C.A. 21-11319. No filing fee or petition for leave to proceed in forma pauperis was submitted with the Petition. On August 16, 2021, Petitioner Ireland resubmitted his Emergency Petition for Writ of Habeas Corpus along with the $5 filing fee. The clerks office treated the duplicate filing as a new action and assigned it C.A. No. 21-11322. The court finds that the second action was opened in error and that the filing fee should have been directed to the first action. Accordingly, the court instructs the clerk to apply the filing fee to the first action and to close the duplicate case. (PSSA, 4) |
