Filing 36 Judge Allison D. Burroughs: ELECTRONIC ORDER entered. Defendants' motion for an extension of time, [ECF No. #32 ], is GRANTED in part and DENIED in part. The Court anticipates that the First Circuit's opinion in the Doe. v. Hopkinton Public Schools case will be released to the public on, or shortly after, November 29, 2021. For this reason, the Court will bifurcate the briefing schedule. Briefing on the "Racial Affinity Group Policy" issue will proceed as scheduled by the Court's October 28, 2021 order. [ECF No. 23 ]. Briefing on the "Biased Speech Policy" issue will be extended slightly and will proceed as follows: Defendants' opposition to the motion for a preliminary injunction is due by December 7, 2021 and Plaintiff's reply in support of its motion for a preliminary injunction is due by December 14, 2021. The hearing on the motion remains scheduled for December 15, 2021 at 10:00 a.m. Should the public release of the Doe. v. Hopkinton Public Schools opinion be delayed, the parties may adjust the briefing schedule so that the "Biased Speech Policy" issue is still fully briefed by December 15, 2021 (i.e., the parties can agree to a 6-day briefing schedule for the opposition and reply). In the alternative, the Court will, at the request of the parties, reconsider the schedule set forth in this Order. The Court is also willing, if need be, to hear argument on the "Racial Affinity Group Policy" issue on December 15, 2021, and either schedule further argument on the "Biased Speech Policy" issue for a later date, or rely on the parties' briefing.
