January 7, 2022 Filing 6 Judge Richard G. Stearns: ELECTRONIC ORDER entered. Defendant Reliance Standard Life Insurance Company having answered the Complaint, the court enters the following briefing schedule:Defendant shall provide plaintiff Linda Searnock with a Proposed Record for Judicial Review by February 18, 2022. The Proposed Record shall consist of all non-privileged documents or videographic materials contained in defendant's claim files concerning the administrative review of plaintiff's claim and all applicable plan documents in defendant's possession. Defendant must provide a privilege log for any documents withheld from the Proposed Record.Upon receiving the Proposed Record, plaintiff shall review and notify defendant's counsel in writing, by March 11, 2022, of all medical or personal identifier information she seeks to redact, or file under seal. Alternatively, if confidential information thoroughly permeates the record, either party may file a motion to seal the entire Record for Judicial Review, on or before March 1, 2021. If after receiving the Proposed Record, plaintiff claims that it is inaccurate or incomplete, she must notify defendant's counsel in writing by March 25, 2022. Any disagreement regarding the record must be filed with the court by April 8, 2022. Any request for an entitlement to discovery must also be filed by April 8, 2022. If no disagreements or requests are filed, defendant's dispositive motion must be filed by April 29, 2021, with plaintiff's response due by May 20, 2022. With such a practicable schedule, the court expects the parties to adhere to these dates unless good cause arises dictating extension. (Zierk, Marsha)
