December 10, 2021 Filing 7 Judge Indira Talwani: ELECTRONIC ORDER: In its Notice of Removal #1 , Defendant Nationstar Mortgage, LLC ("Nationstar") states that it is a Delaware limited liability company with its principal place of business in Texas and that it is a citizen of both Delaware and Texas for purposes of diversity jurisdiction. However, the citizenship of a limited liability company is determined by the citizenship of its members. Pramco, LLC ex rel. CFSC Consortium, LLC v. San Juan Bay Marina, Inc., 435 F.3d 51, 55 (1st Cir. 2006). The jurisdictional issue has the potential to be iterative: if any member of the limited liability company's member is another unincorporated association, the court looks to the citizenship of that member, and so on. D.B. Zwirn Special Opportunities Fund, L.P. v. Mehrotra, 661 F.3d 124, 127 (1st Cir. 2011) (per curiam). Accordingly, Nationstar shall promptly supplement its Notice of Removal with an affidavit of jurisdictional facts relevant to the citizenship of its member(s). The court anticipates dismissing the action without prejudice for lack of subject matter jurisdiction if the parties are not of diverse citizenship.(Dore, Samantha)
