Plaintiff Kwame Kusi was not in attendance. Plaintiff Marc Gordon represented that he still owns an interest in the subject real property and stated that the records of the registry do not fully reflect his interest. Defendant suggested that this case may be subject to resolution on a motion for judgment on the pleadings. The Court ordered the parties to proceed according to the following schedule: Defendant is to file its motion to dismiss by January 12, 2023; Plaintiffs are to file their opposition by February 13, 2023; Defendant may file a reply of no more than five pages by February 21, 2023.Fact discovery is stayed pending further order of the Court. Counsel informed the Court of a pending receivership action in Mass. Housing Court, which could result in liens extinguishing one or more claimed interests in the subject property. Defense counsel will report the status of this matter to the Court by January 31, 2023.
