Under 28 U.S.C. 1915(e)(1), the Court "may request an attorney to represent any person unable to afford counsel." 28 U.S.C. 1915(e)(1). However, a civil plaintiff lacks a constitutional right to free counsel. See DeRoisers v. Moran, 949 F.2d 15, 23 (1st Cir. 1991). To qualify for appointment of counsel, a party must be indigent and exceptional circumstances must exist such that the denial of counsel will result in fundamental unfairness impinging on the party's due process rights. See id. To determine whether exceptional circumstances exist, a court must examine the total situation, focusing on the likelihood of success on the constitutional claim; the factual complexity and legal intricacy of the claim; and the ability of the prisoner to investigate and develop the factual record necessary to the claim. Cavitt v. Saba, 12-cv-11700-WGY, 2012 WL 4094358, at *1 (D. Mass. Sept. 14, 2012). Based on a consideration of those factors here, the court cannot presently find that the case presents exceptional circumstances warranting the appointment of counsel at this stage of the proceedings. Among other things, the court is not yet able to assess the likelihood of success on the merits, particularly where the respondent has not yet filed a responsive pleading, but nothing about any of the claims suggests that the case presents exceptionally complex or intricate issues necessitating additional investigation or development of the record. Accordingly, the petitioner's motion therefore is DENIED, but without prejudice. (mkz) |
