ORDER DISMISSING CASE"Plaintiff was ordered to pay the $402 filing and administrative fee or file a renewed motion to proceed in forma pauperis by February 16, 2023. See Procedural Order, Dkt. 4. A copy of that order was sent to the facility at which MacDonald is detained. As part of the procedural order, the court requested 'that the Treasurer's Office include in any prison account statement the plaintiff's average monthly deposits for the sixmonth period preceding the date the complaint was filed, as well as the average monthly balance for that same period.' Id. On February 6, 2023, the Clerk received and docketed a prisoner account statement and a purported inmate request to proceed in forma pauperis signed by the facility. See Dkt. 5. The court received nothing from MacDonald. Accordingly, the action is hereby dismissed without prejudice for failure to comply with the courts January 26, 2023 Procedural Order. The plaintiffs motion to appoint counsel, Dkt. 2, is denied as moot. The Clerk is directed to enter a separate order of dismissal without prejudice."(PSSA, 5)
