This case was properly removed as plaintiff Adam Moore's Complaint explicitly alleges causes of action under Title VII and the First Amendment to the United States Constitution. Federal district courts have original jurisdiction of all civil actions arising under the Constitution, laws, or treaties of the United States. See 28 U.S.C. 1331. Moore argues that removal to federal court "will prolong the litigation, impose excessive costs, impose undue hardship, and block equitable relief," stating that the Middlesex Superior Court is closer to his house and that his count under Mass. Gen. Laws ch. 151B must be heard there. Notwithstanding defendants' prerogative to remove this matter to federal court, the court notes that on January 11, 2023, it allowed Moore's motion to electronically file and receive pleadings in this case. Moreover, this court regularly hears and decides Massachusetts law claims in its many diversity and employment law cases. Similar to the state court, when appropriate this session accommodates requests from parties to remotely attend their hearings. (mkz) |
