Plaintiff Derek Mortland will produce an expert report regarding the property to defendant no later than October 2, 2023, which should specify with detail the alleged violations of Americans With Disabilities Act, 42 U.S.C. 12181, et seq. (ADA) and the Massachusetts Public Accommodations Act, Mass. Gen. Laws. ch. 272, 98 (the court notes the many generalized claims in 15 of the Complaint). Defendant may respond to the report with its own expert report by November 20, 2023.Without leave of court, the court permits 30 interrogatories, 30 requests for admissions and 30 document requests, to be filed the opposition within the next 30 days of receipt of the opposing parties expert report, and expects responses to be made in thirty days, unless a request for additional time is granted for good cause. A party may not notice more than 3 deponents without leave of court. If all parties are interested in the court's mediation program, they must notify our docket clerk Arnold Pacho (617-748-9812) by 1/23/24 (it may take several weeks to get a mediation date). All fact discovery must be completed no later than 3/18/24. Dispositive Motions are due by 4/22/24, with Oppositions to dispositive motions due 5/13/24; Reply, if any, by leave of court.
