Filing 6 Judge William G. Young: ELECTRONIC ORDER entered. On June 6, 2023, plaintiff Joel Jeannite was granted leave to proceed in forma pauperis and ordered to file an amended complaint by June 16, 2023. See Docket No. 4. Jeannite has not responded to this Court's order and the time to do so has expired. It is a long-established principle that the court has the authority to dismiss an action sua sponte for a party's failure to prosecute and to follow the courts orders. Rule 41(b) of the Federal Rules of Civil Procedure expressly authorizes a district court to dismiss a case [i]f the plaintiff fails to prosecute or to comply with these rules or a court order.... Fed. R. Civ. P. 41(b). Accordingly, this action is dismissed for plaintiffs failure to (1) comply with the June 6, 2023 order; (2) prosecute; and (3) to state a claim upon which relief may be granted pursuant 28 U.S.C. 1915(e)(2)(B)(ii). The Clerk shall enter a separate order of dismissal.(PSSA, 4) |
