On May 19, 2023, the plaintiffs filed this products liability action in Middlesex Superior Court. (Dkt. No. 1-1). That same day, the defendants, each of which has a principal place of business in Massachusetts, removed the action to this court, invoking the court's diversity jurisdiction under 28 U.S.C. 1332(a). (Dkt. No. 1). The case was randomly drawn to me. (Dkt. No. 2). The parties have not consented to proceeding before a magistrate judge. Soon after the defendants filed the notice of removal, the plaintiffs filed an emergency motion to remand the case to state court, arguing that the removal was improper. (Dkt. No. 4). The defendants now agree that the case should be remanded and have filed an assented-to motion to withdraw the notice of removal. (Dkt. No. 6). Accordingly, I order that the case be redrawn to a district judge and recommend that the district judge allow the assented-to motion to withdraw (Dkt. No. 6), deny the motion to remand as moot (Dkt. No. 4), and remand the case to Middlesex Superior Court. Objections to R&R due by 6/14/2023. (Russo, Noreen) |
