The Court had previously remanded this action for lack of subject-matter jurisdiction. (See Civil Action No. 23-10128-FDS, Docket Nos. 20-21). Plaintiff's emergency motion to remand (Docket No. #7 ) is hereby GRANTED. Accordingly, defendant's motion to reconsider the order of the Barnstable Court, stay the order's execution, enjoin plaintiff, and extend deadlines (Docket No. #5 ) is DENIED as moot. Defendant is hereby warned that any future attempt to remove the case to federal court without a plausible basis may result in sanctions and an award of attorneys' fees. So Ordered.
