Filing 20 Judge Indira Talwani: ELECTRONIC ORDER: On September 29, 2023, after Plaintiff Tau, who is proceeding pro se, filed numerous documents without first serving the Defendants, and where it was unclear whether Tau sought to proceed under his initial complaint or a later filed complaint, the court held a status conference with Tau. The court explained that if Tau sought to also include a later filed claim, he must do so in one filing and not through multiple filings. The court granted Tau leave to file a single consolidated complaint no later than October 20, 2023. After October 20, Plaintiff may only amend his complaint with leave of court. Unless an Amended Complaint is filed, the court will treat the original Complaint #1 filed on August 10, 2023, as the operative complaint. Filing 12 Judge Indira Talwani: ELECTRONIC ORDER: On August 10, 2023, Plaintiff Aren S. Tau initiated this action by filing a Complaint #1 , Supplement of Complaint [1-1], civil cover sheet [1-2] and Motion for Return of Property #2 and paid the $402 filing fee. The clerk's office issued summonses for Tau to serve on Affordable Towing, Ally Bank, Boston City, Boston Police, Boston Public School, Doordash, Grabhub, Lakeville Police Station, and RMV. Plaintiff has not yet filed any returns of service, but has filed numerous additional documents. Plaintiff's Motion to Return Property #7 and Motion for Monsanto #10 are denied without prejudice where they seek the same relief as the pending Motion for Return of Property #2 . Plaintiff has also filed two additional complaints, Complaint #8 and Complaint #9 . A Plaintiff may amend his complaint once as a matter of course within 21 days of serving the original complaint but a second amended complaint requires leave of court. Accordingly, where Plaintiff did not file a motion for leave to amend, Complaint #9 is stricken. Plaintiff's Complaint #8 , filed August 21, 2023, was filed within 21 days of the original Complaint #1 , and accordingly, in the normal course, Complaint #8 would be considered the operative complaint and would supersede the original Complaint #1 . If Plaintiff seeks to proceed with Complaint #8 as the operative Complaint, the court will issue summons for the additional Defendant, Mary Skipper, but all of the Defendants not listed in Complaint #8 will be dismissed. Given that Plaintiff is proceeding pro se and may not have understood the impact of filing an amended complaint listing different Defendants, the clerk shall set a status conference to allow Plaintiff to state on the record which complaint he would like to pursue.Plaintiff's Motion for Leave to File Electronically #11 is denied.
