On December 19, 2023, defendant moved to dismiss the complaint on the ground that plaintiffs claims are identical to those dismissed by this court in another case involving the same parties (No. 22-11298), and, alternatively, for failure to state a claim upon which relief can be granted. The deadline to respond to that motion was January 2, 2024. Plaintiff failed to file any opposition by that deadline, and has yet to do so. In light of his pro se status, plaintiff is hereby ORDERED to show cause in writing by February 29, 2024, why this case should not be dismissed.
