ORDER granting on consent, request to transfer. Upon review of Defendant's motion to compel the deposition of Debra Duguid (the deponent) or alternatively to transfer the motion to compel to the District of Massachusetts (ECF No. 1), and in light of the emergent nature of the relief sought, the Court inquired of the Plaintiff and the deponent (who are represented by the same counsel), via e-mail on August 28, 2023, whether they consent to a transfer of the motion to the presiding district judge in the underlying litigation, IEP Technologies, LLC, v. KPM Analytics, et al., Civil Action No. 1:21-cv-10417-RWZ (D.Mass). The parties and deponent have advised the Court that they consent to a transfer of the motion to the District of Massachusetts for adjudication, with the deponent reserving all rights to oppose and file an opposition in the district court in Massachusetts.
