Filing 6 District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. This lawsuit arises out of a looming foreclosure. Today, April 8, 2024, Plaintiff Sylvester Uwagboe filed a complaint naming as defendants the law firm conducting the foreclosure, the servicer of the mortgage loan and the bank holding the mortgage loan. The property is a two family home owned by the plaintiff for investment purposes; he does not live there according to the complaint. Plaintiff has filed an Emergency motion for temporary and preliminary injunctive relief to prevent an anticipated foreclosure noticed for April 18, 2024. The Courts review of exhibits attached to the Motion indicate the date appears to be April 18, 2024. In light of that the Court will hold a prompt hearing on the Motion pursuant to the following Order and schedule. Plaintiff shall (1) complete service; (2) provide each defendant with the Emergency Motion (Docket #2) along with this Order; and (3) file a certificate with this Court stating that it has served each defendant as required by the Federal Rules of Civil Procedure and complied with the additional requirements of this Order. Plaintiff shall complete the foregoing by April 10, 2024. Defendants shall file their responses to the Motion by noon on April 16, 2024 and the Court will hold a hearing on the Motion on April 17, 2024 at 10:00 a.m. (Dore, Samantha) |
