May 17, 2024 Filing 8 Electronic Clerk's Notes for proceedings held before District Judge Julia E. Kobick: Hearing held on 5/17/2024 by video conference.Case called. The Court informs the parties it has a few questions regarding the consent decree. The Court confirms with the defendant that the government has filed a complaint against her and breaks down the complaint to make sure she understands the complaint. The government confirms the outline the Court provided to the defendant of the complaint is correct as alleged. The government states its main goal is to stop the conduct of Ms. Pena. The Defendant confirms she signed the stipulation #2 on March 18, 2024, and the Court reviews the stipulations to make sure the defendant understands what she agreed to in the consent decree. The Defendant states she has no further questions if the Court endorses the consent decree. The Court asks the government about the consequences of not complying with the consent decree. The government states it did not set out consequences of non-compliance in the decree itself, but in the letters the defendant has previously received, the possible consequences were laid out including civil contempt, request potentially more stringent monitoring conditions on bank accounts and potentially criminal contempt if warranted. The Court will endorse the Consent Decree and will file it on the docket. The government confirms a postal inspector will serve a copy of the consent decree in person to the defendant.
