ORDER DELAYING ISSUANCE OF SCHEDULING ORDER, VACATING SCHEDULING CONFERENCE, AND GRANTING PLAINTIFF ENLARGEMENT OF TIME: This matter is before the Court sua sponte. There are two defense motions pending on the docket: (1) Defendant's Motion to Dismiss (Dkt. 18) and (2) Defendant's Motion to Transfer Venue (Dkt. 19). Plaintiff opposes both motions. The Court believes it prudent to resolve the Motion to Transfer Venue before issuing a Scheduling Order in this case. In light of that motion, the Court finds good cause under Rule 16(b)(2) to delay convening a Scheduling Conference and issuing a Scheduling Order until a final ruling on the Motion to Transfer Venue. Therefore, the Scheduling Conference set for later this morning is VACATED.Plaintiff also filed an Unopposed Motion for Enlargement of Time to Respond (Dkt. 26) to the pending Motions. For the parties' future reference, when that motion was filed the filer selected the CM/ECF action for "stipulation" instead of selecting "motion." All motions should be filed selecting the "motion" option. This is important because "motions" are flagged by the system for the Court's attention and tracking, whereas "stipulations" are not flagged, and therefore, may get lost in the shuffle of filings. Please remember this when filing any future unopposed or stipulated motions. That said, Plaintiff's motion is GRANTED.
