Service by publication is not expressly authorized by the Federal Rules of Civil Procedure, but it may be permissible if it is acceptable under state law for serving a summons in an action brought in courts of general jurisdiction in the state where the district court is located or where service is made. Fed. R. Civ. P. 4(e)(1) (individuals); Fed. R. Civ. P. 4(h)(1)(A) (corporations). Under Massachusetts law, [i]f the person authorized to serve process makes return that after diligent search he can find neither the defendant, nor defendants last and usual abode, nor any agent upon whom service may be made... the court may on application of the plaintiff issue an order of notice in the manner and form prescribed by law. Mass. R. Civ. P. 4(d)(1); accord Mass. R. Civ. P. 4(d)(2) (stating an analogous rule for corporations). Before a Court can approve alternative service, however, the plaintiff must show sufficiently diligent efforts to effectuate service in a conventional manner. Alves v. Daly, No. 12-cv-10935, 2013 WL 1330010, at *4 (D. Mass. 2013); accord Swenson v. Mobilityless, LLC, No. 19-cv-30168, 2020 WL 2404835, at *12 (D. Mass. 2020). Here, plaintiff has not demonstrated that he exhibited the requisite diligence, Alves, 2013 WL 1330010, at *4, in attempting to locate Defendants and serve them through traditional methods. The Court will not approve alternative service at this time, but Plaintiff may refile the motion with further evidence of his efforts to complete service. (CAM) |
