No. 29 ) is hereby DENIED to the extent that it relies on the earth movement exclusion and DENIED WITHOUT PREJUDICE to the extent that it relies on allegations of fraud. Plaintiff will have until June 30, 2012 to conduct discovery on the fraud issue, and Defendant may file a renewed motion for summary judgment by July 31, 2012. Alternatively, if counsel agree that the case is not appr opriate for summary judgement, they may request the court to schedule a final pretrial conference in preparation for trial. Defendants Motion to Amend (Dkt No. 27 ) is hereby ALLOWED, and Plaintiffs Motion to Strike (Dkt. No. 38 ) is hereby DENIED. See the attached memo and order for complete details. (Lindsay, Maurice)
