Ponsor: MEMORANDUM AND ORDER entered, as follows: The court finds that Defendants' policy of permitting male guards to videotape strip searches, even if no viewing occurred, in non-emergency situations, violated the class member s' constitutional rights and that no legitimate, penological interest justified it. Defendants' Motion for Summary Judgment (Dkt. No. 156) is hereby DENIED, and Plaintiffs' Motion for Summary Judgment (Dkt. No. 171) is hereby ALLOWED on the issue of liability. By September 9, 2014, Plaintiff shall submit a proposed schedule to address the questions of potential equitable relief and monetary damages. If Plaintiff's proposal is not assented to, Defendants may submit their counter-proposal by September 23, 2014. It is So Ordered. See the attached memorandum and order for full decision.
