Judge Michael A. Ponsor: MEMORANDUM AND ORDER entered. As follows: For the reasons stated, the Report and Recommendation of the Magistrate Judge (Dkt. No. 35 ), upon de novo review, is hereby ADOPTED in its entirety. Defendants motion to dismiss (Dk t. No. 12 ) is hereby ALLOWED in part, as to the question of the scope of potential damages, and is otherwise DENIED.
