The court notes the parties have essentially reversed positions on this issue since the court's April 4, 2016 Memorandum and Order (Dkt. No. 287), with Plaintiffs now seeking a complete stay of discovery pending resolution of the criminal case and Defendant seeking to maintain the partial stay. The court will maintain the partial stay in light of the following observations. First, the court already considered Plaintiff's concerns regarding unequal discovery obligations in its original ruling and remains convinced that a partial stay only as to discovery directed to Defendant adequately avoids a prejudicial Fifth Amendment dilemma while also allowing discovery to progress as much as possible. While the court appreciates Plaintiffs' assertion that their third-party discovery is hampered by the partial stay, it anticipates Plaintiffs will be permitted to re-open and/or continue such discovery on a liberal basis, where appropriate, based on Defendant's discovery responses following the criminal case (as Defendant himself acknowledges may be appropriate). Second, as to Plaintiffs' concern regarding Defendant allegedly misusing discovery in this action for use in his criminal case, that issue can be addressed on a case-by-case basis through particularized motions, in relation to which Defendant should be required to demonstrate that the discovery is sought in good faith and is specifically relevant for purposes of this case. Provided Defendant can meet that standard, the fact that the discovery may also be relevant in the criminal case does not, in the court's view, alone provide a basis for denying such discovery here. Plaintiffs' motion, which takes issue with the adequacy of many responses contained in Defendant's Answer to the Third Amended Complaint, is more properly brought as a motion to strike under Rule 12(f), not a motion for judgment on the pleadings under Rule 12(c). See Guessford v. Pennsylvania Nat'l Mut. Cas. Ins. Co., 918 F. Supp. 2d 453, 467 & n.7 (M.D.N.C. 2013; Burns v. Consolidated Amusement Co., 182 F.R.D. 609, 611 (D. Haw. 1998); Brenston v. Hammond Housing Auth., 2005 WL 2204865, at *1 (N.D. Ind. Sept. 9, 2005). This court rejects Plaintiffs' claim that a judgment on the pleadings is the relief available for these assertions of deficiencies in Defendant's answer. Accordingly, treated as a motion to strike, the request is untimely, as Rule 12(f) requires filing "within 21 days after being served with the pleading." Fed. R. Civ. P. 12(f). Even if the court were to ignore this untimeliness, the appropriate relief would be to require Defendant to file an amended answer clarifying any deficient responses, as recognized by the vast majority of cases Plaintiffs cite. In Plaintiffs' communications with Defendant, however, they have made clear that they "do not seek clarifications of the Answer, but rather a judicial determination that Defendant has admitted the 11 allegations at issue." (Dkt. No. 407, Ex. B.) Plaintiffs' position, essentially seeking to capitalize on claimed technical defects in a pleading filed nine-and-a-half months ago, is entirely contrary to the spirit of the Federal Rules of Civil Procedure, which "reject the approach that pleading is a game of skill in which one misstep by counsel may be decisive to the outcome and accept the principle that the purpose of pleading is to facilitate a proper decision on the merits." Conley v. Gibson, 355 U.S. 41, 48 (1957); see also Rodi v. Southern New England School of Law, 389 F.3d 5, 20 (1st Cir. 2004) (citing Conley, 355 U.S. at 48 and Fed. R. Civ. P. 1). The event was a retirement "roast" held in Springfield on April 7, 2011 and included appearances by several local public figures and officials. The Defendant and the Judge (then District Attorney) were briefly introduced and photographed together immediately before the program commenced.This was the complete extent of the meeting between the Judge and the Defendant. The event was reported by local media and that coverage can be reviewed at the websites of those news organizations. This disclosure is being made to comply with the purpose and intent of the Code of Judicial Conduct for United States Judges, Canon 2. The Court identifies no actual conflict or the appearance of a conflict, considering this disclosure of relevant circumstances, based on the brief meeting and appearance with the Defendant.
