Magistrate Judge Katherine A. Robertson: ORDER entered re: Defendant's 26 Motion for Summary Judgment. For the foregoing reasons, Defendant's Motion for Summary Judgment (Dkt. No. 26) is DENIED as to the negligence cause of action in th e complaint, but ALLOWED with respect to the application of Mass. Gen. Laws ch. 231, § 85K, which limits recoverable damages to $20,000 exclusive of interest and costs. Counsel are directed to confer and propose three mutually convenient dates prior to March 15, 2019 for a status conference. (Finn, Mary)
